Duty to Disclose: Sellers (and their agents) must disclose any defects that might affect a buyer's use and enjoyment of the property. Latent (hidden) defects that are known to the seller must be disclosed if they pose a serious risk to health and safety. Sellers cannot intentionally conceal patent defects.
